Terms and Conditions

Terms of use for the Glenby app and website. This is a translation for convenience. The German version is legally binding.

Provider and scope

These terms apply to the use of the Glenby app and website, offered by Ebrahim Seyfi (Geschäftsbezeichnung „Senorit"). Address and contact details can be found in the Legal notice.

Who may use Glenby

Glenby is intended exclusively for adults. You must be at least 18 years old to use Glenby; by registering, you confirm you have reached the age of majority as a self-declaration. We do not carry out an ID check. If you provide false information here, we are entitled to suspend or terminate your account.

Rules for your content

Share only content you are entitled to share. Illegal, harmful, or rights-infringing content is not permitted, in particular sexualized depictions of minors. Such content is intercepted on the device already, to the extent technically possible (see Security & Transparency). You are responsible yourself for what you share. What rights you grant us to shared content is set out in the section "Rights to shared content".

Rights to shared content

You confirm that you hold all rights necessary for the content you share through the service (including photos, voice notes, videos), or that its use within the service is otherwise permitted.

You grant Senorit a simple right of use, limited to the technical provision of the service, to the content you share, in particular for encrypted storage, transmission to the recipient you designate, and, where technically necessary, the creation of preview images. No use beyond this takes place, in particular for advertising purposes or to train AI models.

If content you share culpably infringes the rights of a third party, you indemnify Senorit against third-party claims based on this, to the extent these result from a breach of duty on your part and Senorit did not itself contribute to the infringement. This includes reasonable costs of legal defense. Further-reaching claims remain unaffected.

Senorit may suspend or terminate user accounts, after a warning, in the event of repeated, substantiated reports of infringement.

Moderation and reporting violations

Unlawful content and conduct are not permitted, in particular content that violates applicable law (such as sexualized depictions of minors), harassment, fraud, and the infringement of third-party rights. On substantiated reports of violations, we may remove content and restrict or terminate accounts.

You can report unlawful content in the app, or informally by email to legal@glenby.de, regardless of whether you hold a Glenby account yourself. An effective report includes a sufficiently substantiated explanation of why the content is unlawful, its exact location (for example username, timestamp, screenshot), the name and email address of the reporting person, and a statement that the information is accurate to the best of their knowledge. Content in private 1:1 chats is end-to-end encrypted; we have no technical access to its content and can only act on reports about chat content at the account level, for example by reviewing the reported profile.

We confirm receipt of your report, review the reported matter, and inform you of our reasoned decision and your options for contesting it. A human always decides on account suspensions or terminations; no purely automated decision-making without human review takes place.

Outdoor activities

The tasks in Glenby take place outdoors and are undertaken at your own responsibility. Assess the terrain, weather, and your own abilities yourself, and observe local rules, for example on nature conservation or private property.

Paid features, prices, and payment

Some features are paid (subscriptions as well as individual, one-time in-app purchases). The current names, features, prices, and billing periods are shown to you before purchase in the app or on the order page; all prices include statutory value-added tax.

A paid contract is only formed if the ordering situation clearly indicates this: where the order is placed via a button, that button must be clearly labelled with the words „zahlungspflichtig bestellen" (German for "order with obligation to pay") or an equivalently unambiguous wording (§ 312j BGB). Without such a label, no contract is formed. Subscriptions renew automatically for the respective period until cancelled.

Cancellation

You can cancel a running subscription at any time, effective at the end of the current billing period - via the cancellation button "Cancel contracts here" at glenby.de/kuendigen, via the cancellation function in your account or the app, or via the payment management of your app store, if the purchase was completed there. This cancellation function is distinct from your statutory right of withdrawal: cancellation ends a running subscription for the future, whereas withdrawal retroactively undoes the original conclusion of the contract.

After the initial term ends, a subscription continues for an indefinite period and can then be cancelled at any time with a notice period of at most one month (§ 309 Nr. 9 BGB). You can give notice via the cancellation button at glenby.de/kuendigen, via the cancellation function in the app, via the payment management of your app store or payment provider, or informally by email to legal@glenby.de.

Right of withdrawal

As a consumer, you have a statutory right of withdrawal for paid contracts. The full withdrawal instructions, the model withdrawal instructions, the model withdrawal form, and the permanently available withdrawal function under § 356a BGB can be found on the Right of withdrawal page.

Telecommunications law notices

Glenby is not a substitute for a telephone service. Emergency calls (110/112) are not possible through Glenby.

Glenby is a number-independent interpersonal telecommunications service provided by a microenterprise; pursuant to § 71 Absatz 4 TKG, §§ 52 to 67 TKG do not apply.

Availability

We make an effort to keep Glenby running reliably, but we cannot guarantee uninterrupted availability.

Suspension and termination

You can delete your account at any time (see account and data deletion). In the event of serious or repeated violations of these terms, we may suspend or terminate an account.

Liability

Glenby is provided with reasonable care. Liability for damages arising from taking part in the tasks is excluded to the extent permitted by law; liability for intent, gross negligence, and for damages resulting from injury to life, body, or health remains unaffected.

Changes and governing law

We may amend these terms. We will inform you of material changes with reasonable notice in text form, for example by email or an in-app notice (Art. 14 Abs. 2 DSA). The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, to the extent legally permissible.
